Twenty-one states have enacted anti-trans bathroom bans. These states segregate restrooms and other facilities by sex-assigned at birth in at least some situations, and two states make using the restroom aligned with one’s gender identity, rather than sex assigned at birth, a crime.
Arizona - Legislature advances proposed anti-trans ballot questions. The Senate approved SCR 1006 on February 23rd, which, if approved in the House as well, would put to voters whether to enact an anti-trans facilities ban at public schools. Colorado - Signatures submitted for proposed anti-trans ballot measures. Protect Kids Colorado, a coalition led by anti-LGBTQ+ activist Erin Lee, submitted signatures for ballot measures that, if approved by voters, would enact an anti-trans athlete ban as well as banning gender-affirming surgeries for trans and nonbinary youth. The Secretary of State must verify the validity of the gathered signatures before the proposed ballot measures are put to voters in the November elections.
Idaho - Resolution introduced asking Supreme Court to overturn Obergefell decision. Rep. Tony Wisniewski (R-Post Falls) introduced a resolution on February 23rd that calls on the U.S. Supreme Court to reverse its decision in Obergefell v. Hodges, which legalized same-sex marriage nationwide. The resolution would not carry the force of law. Kansas - Transgender Kansans sent letters informing them that their driver’s licenses are invalid. The Kansas Department of Revenue’s vehicles division sent letters dated February 23rd to some transgender Kansans informing them that, with SB 244 adopted as law, driver’s licenses reflecting transgender Kansans’ gender identities are invalid as of February 26th. The letter instructs people, per the new law, “if the gender/sex indication on the face of your current credential does not match your sex assigned at birth, you are directed to surrender your current credential to the Kansas Division of Vehicles.” New Hampshire - Legislature considers more anti-trans legislation. The House Judiciary Committee advanced a bill that would require some public and private facilities to segregate their restrooms by sex assigned at birth. The committee also advanced a bill which would require government buildings to segregate bathrooms and locker rooms by sex assigned at birth while allowing, rather than requiring, the same of private businesses. New York - Mount Sinai Health System halts provision of medically necessary care to trans and nonbinary youth. Families receiving care at Mount Sinai hospital say the hospital contacted them to inform them that the hospital would no longer be able to provide gender-affirming care to trans and nonbinary youth. Tennessee - House passes bill allowing private citizens, businesses to refuse to recognize same-sex marriages. The House passed HB 1473 on February 19th, which would allow private citizens, as well as banks, hospitals, and insurance companies to refuse to recognize same-sex marriages. Vanderbilt Health announces it will no longer provide gender-affirming surgery to adults. In a statement released February 20th, Vanderbilt University Medical Center announced “Due to operational limitations and lack of surgical coverage, Vanderbilt Health will cease providing gender-affirming plastic surgeries for adults.”
